Warning: By accepting this document, the participant is giving up certain legal rights, including the right to sue for claims arising from ordinary negligence.

This document outlines the terms under which participants engage in group reformer Pilates classes and related services provided by 1001184549 Ontario Corp., operating as Pilates Hub Newmarket (“Pilates Hub Newmarket”, “we”, “us”, “our”).

By creating an account, booking, attending, or participating in any class, event, or service, the participant acknowledges that they have read, understood, and voluntarily agree to be legally bound by this waiver.


Acknowledgement of risks

Participation in group reformer Pilates classes involves physical exertion and the use of specialized equipment, including reformers, springs, straps, boxes, weights, and props.

Participation carries inherent risks of injury, which may include muscle strain, sprains, joint injury, falls, dizziness, fainting, overexertion, cuts or pinches from moving parts, equipment malfunction, or other physical harm.

Participants agree to follow all instructor directions, safety guidelines, and studio rules, and to exercise within personal limits.

Participants agree to notify staff of any visible damage, unusual sounds, or conditions that appear unsafe before use, and not to use equipment they believe may be unsafe.

Challenge level may be adjusted, but risk cannot be eliminated. By choosing to participate, participants voluntarily assume these risks.

If pain, dizziness, shortness of breath, or any unusual discomfort occurs at any time during participation, participants must stop immediately and notify the instructor or nearest staff member.


Health status and pregnancy

Participants must be 18 years of age or older to attend classes. By accepting this waiver, the participant confirms they meet this age requirement. Pilates Hub Newmarket reserves the right to request proof of age and to refuse participation where this requirement is not met.

Participants confirm they are in suitable physical condition to participate and have disclosed any relevant medical conditions, injuries, limitations, or symptoms that may affect safe participation.

Instructors and staff are not medical professionals and do not diagnose conditions or provide medical advice.

Pregnancy: Participants who are pregnant must obtain written medical clearance from their healthcare provider before attending classes. Pregnant participants agree to inform instructors of pregnancy before class and to follow recommended modifications. Pilates Hub Newmarket may request written confirmation or verbal assurance of medical clearance at our discretion.

The studio reserves the right to restrict participation or require medical clearance when there is a reasonable concern for safety. Participants must stop exercising and notify staff if they feel pain, dizziness, faintness, shortness of breath, chest pain, or unusual discomfort.


No medical advice

Information provided by instructors or staff, whether verbally, in writing, or online, is for general educational purposes only and is not medical advice. Participants should consult a qualified healthcare provider regarding any medical concerns or prior to beginning a new exercise program.


Health transparency, contraindications, and right of refusal

Participants agree to disclose relevant health conditions or concerns before participating and to update the studio if anything changes.

Participants agree not to participate while impaired by alcohol, recreational drugs, cannabis, or medications/substances that affect judgment, balance, or coordination.

For safety, Pilates Hub Newmarket reserves the right to refuse or restrict participation to anyone we reasonably believe may be at increased risk of harm from physical activity or equipment use, including, but not limited to, pregnancy without clearance, recent surgery, uncontrolled cardiovascular or respiratory conditions, or acute illness. Any fees or credits are handled in accordance with the Terms of Service and applicable law.


Hands-on adjustments

Instructors may offer tactile cueing or hands-on adjustments for alignment and safety purposes only. Hands-on adjustments are for positional guidance only and are not therapeutic treatment.

Consent may be withdrawn at any time, including verbally before or during class.


Photography and video

Group classes may occasionally be photographed or filmed for promotional purposes, such as social media stories or posts.

Participants who do not wish to appear may opt out by emailing hello@pilateshub.ca or by notifying any staff member in person at any time — including upon arrival to any class. Once a participant has opted out, this preference will be applied to all future sessions and will remain on file. The studio will take reasonable steps to honour the request and will not use existing photos or recordings of an opted-out participant for future promotional purposes.

Photos or recordings will not be sold or shared with third parties for unrelated commercial use.


Service animals and personal belongings

Service animals are permitted on the premises in accordance with applicable Ontario accessibility and human rights requirements. Participants bringing service animals must ensure the animal remains under control and does not interfere with class safety.

Lockers may be available for convenience. Pilates Hub Newmarket is not responsible for loss, theft, or damage to personal property.


Assumption of risk

By participating in any Pilates Hub Newmarket activity, participants freely and voluntarily assume all ordinary risks associated with Pilates training and the use of studio facilities and equipment, including risks arising from their own actions or omissions, those of others, or general conditions of the premises and equipment.


Waiver and release of liability

To the fullest extent permitted by law, including under the Occupiers' Liability Act, R.S.O. 1990, c. O.2, participants waive and release any and all claims against Pilates Hub Newmarket and its owners, officers, employees, contractors, instructors, and agents for any injury, illness (including communicable illness or infection that may be transmitted in a shared studio environment), or damage arising out of or related to participation in classes or use of studio facilities and premises — including reformer studios, common areas, washrooms, change rooms, waiting areas, entrances, stairways, and any other areas of the premises or building — including claims arising from ordinary negligence.

This release is intended to operate as a restriction of the occupier's duty of care as authorized under section 3(3) of the Occupiers' Liability Act, and Pilates Hub Newmarket has taken reasonable steps to bring this restriction to participants' attention as required by section 5(3) of that Act.

This release does not apply to gross negligence, wilful or reckless misconduct, or to the extent liability cannot be waived under applicable law.

Participants further acknowledge that injury may result from the actions or omissions of other participants during classes. To the fullest extent permitted by law, participants waive and release any claims against other participants of Pilates Hub Newmarket arising from ordinary conduct during classes or use of studio facilities.


Indemnity (limited)

Participants agree to indemnify and hold harmless Pilates Hub Newmarket and its owners, employees, contractors, instructors, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising directly from the participant’s violation of studio rules, misuse of equipment, or negligent acts or omissions, except to the extent caused by the studio’s gross negligence, wilful misconduct, or breach of statutory duty.


Emergency care

In the event of an injury or medical emergency, participants authorize Pilates Hub Newmarket to obtain reasonable assistance, including first aid and contacting Emergency Medical Services (EMS) if necessary. Participants consent to the disclosure of relevant personal information to emergency responders where required and authorize us to contact their listed emergency contact when reasonably necessary.

By providing an emergency contact's details, participants confirm that the named individual has been informed of and consents to their personal information being shared with Pilates Hub Newmarket for the sole purpose of being contacted in a medical emergency.

Pilates Hub Newmarket staff may not be medically trained, and any assistance provided is voluntary and limited.

Participants are responsible for any related medical costs.


Privacy, geo-check-in, and electronic communications

When using the Pilates Hub Newmarket mobile app, location data may be processed only at the moment of check-in near the studio for attendance verification. No continuous location history is stored.

Participants acknowledge that personal information provided — including health-related information collected in the intake form — is collected solely for the purposes of safety screening, class modifications, and emergency response. Health information will not be shared with third parties except as required by law or in a medical emergency. All personal information is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and our Privacy Policy. Participants have the right to request access to or correction of their personal information by contacting hello@pilateshub.ca.

Participants agree to receive transactional communications and, where separately consented, promotional messages in accordance with CASL and the Privacy Policy.


Governing law

This waiver and any related dispute shall be governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Any legal proceedings shall be brought in Ontario. Dispute resolution is as set out in the Terms of Service.


Consumer protection rights

Nothing in this waiver limits or excludes any rights participants may have under Ontario's Consumer Protection Act, 2002 (CPA). If a membership or service agreement requires payment of $50 or more in advance, participants have the right to cancel within 10 days of receiving a written copy of their contract without providing a reason. Cancellation rights, contract terms, and renewal conditions are set out in the Terms of Service. In the event of any conflict between this waiver and mandatory consumer protection rights under applicable law, those rights prevail.


Entire agreement, severability, and electronic acceptance

This waiver operates together with the Terms of Service and Privacy Policy available on the Pilates Hub Newmarket website.

If any provision of this waiver is found invalid or unenforceable, the remaining provisions will continue in full force and effect.



By creating an account, booking a class, or attending a session, participants agree that this waiver is accepted electronically in accordance with the Electronic Commerce Act, 2000 (Ontario) and has the same legal effect as a signed paper document.
