Informed Consent, Assumption of Risk & Waiver of Liability

This document outlines the terms under which participants engage in group reformer Pilates classes and related services provided by 1001184549 Ontario Corp., operating as Pilates Hub Newmarket (“Pilates Hub Newmarket”, “we”, “us”, “our”).

By booking or attending any class, event, or service, participants acknowledge that they have read, understood, and voluntarily agree to the following terms.

1. Acknowledgement of Risks

Participation in group reformer Pilates classes involves physical exertion and the use of specialized equipment, including but not limited to reformers, springs, straps, boxes, weights, and props.

Participants understand and accept that such activities carry inherent risks of injury, which may include muscle strain, joint injury, falls, equipment malfunction, overexertion, dizziness, or other physical harm.

Participants agree to follow all instructor directions, safety guidelines, and studio rules to minimize these risks.

Participants agree to inspect equipment before use and to immediately report any defect or unsafe condition.

Participants acknowledge that the level of challenge may be adjusted, but that some risk remains at all levels of participation. By continuing to participate, they voluntarily assume all such risks.

2. Health Status & Pregnancy

Participants affirm that they are in suitable physical condition to participate in Pilates classes and have disclosed any relevant medical conditions or injuries to the studio or instructors. Instructors are not medical professionals and do not provide medical advice.

Participants who are pregnant must obtain written medical clearance from their healthcare provider before attending classes. The clearance must confirm that Pilates exercise is safe for their pregnancy stage. Pregnant participants agree to inform instructors of their pregnancy and to follow all recommended modifications.

While Pilates can be beneficial during pregnancy, it may also present risks such as abdominal strain, reduced circulation when lying on the back, and increased fall risk due to hormonal changes affecting joint stability.

Pregnant participants are encouraged to consult regularly with their healthcare provider and to update the studio of any changes in medical status.

We may request written confirmation or verbal assurance of medical clearance at our discretion.

The studio reserves the right to restrict participation or require medical clearance when there is a reasonable concern for safety. Participants must immediately stop exercising and notify staff if they feel pain, dizziness, or discomfort.

3. No Medical Advice

Information provided by our instructors or staff, whether verbally, in writing, or online, is for general educational purposes only and should not be interpreted as medical advice. Participants should consult a qualified healthcare provider regarding any medical concerns or prior to beginning any new exercise program.

4. Health Transparency, Contraindications & Right of Refusal

Participants agree to disclose any relevant health conditions or concerns before participating. Failure to disclose may increase the risk of injury or other complications. Pilates Hub Newmarket relies on honest communication to ensure safe participation and appropriate exercise modification.

Participants agree not to participate while impaired by alcohol, recreational drugs, or medications that affect judgment or coordination.

For safety, Pilates Hub Newmarket reserves the right to refuse participation to anyone we reasonably believe may be at risk of adverse effects from physical activity or equipment use, including but not limited to pregnancy without medical clearance, recent surgery, uncontrolled cardiovascular or respiratory conditions, or any acute medical episode.

This right may be exercised without refund where necessary to protect participant health and studio safety.

5. Hands-On Adjustments

Instructors may offer tactile cueing or hands-on adjustments for alignment and safety purposes only if the participant has opted in during account setup or via written consent. Hands-on adjustments are intended solely for positional guidance and safety; they are not therapeutic treatment.

Consent may be withdrawn at any time, including verbally before class.

6. Photography & Video

Group classes may occasionally be photographed or filmed for promotional purposes, such as social-media stories or posts.

Participants who wish not to appear in such materials may opt out by emailing info@pilateshub.ca prior to class. The studio will take reasonable steps to avoid capturing those individuals or to accommodate their request.

Photos or recordings will never be sold or shared with third parties for unrelated commercial use.

Recording or photography by clients is not permitted without prior written studio consent.

7. Service Animals & Personal Belongings

Only service animals are permitted on the premises, in accordance with the Accessibility for Ontarians with Disabilities Act (AODA) and the Ontario Human Rights Code. Participants bringing service animals must ensure the animal remains under control and does not interfere with class safety.

Lockers are available for convenience; Pilates Hub Newmarket is not responsible for loss, theft, or damage to personal property.

8. Assumption of Risk

By participating in any Pilates Hub Newmarket activity, participants freely and voluntarily assume all ordinary risks associated with Pilates training and the use of studio facilities and equipment.

This assumption includes risks arising from their own actions or omissions, those of others, or general conditions of the premises and equipment.

9. Waiver of Liability

To the fullest extent permitted by law, participants hereby waive and release any and all claims against Pilates Hub Newmarket, its owners, officers, employees, contractors, and agents for any injury, illness, or damage arising out of or related to participation in classes or use of facilities, including those arising from ordinary negligence.

This release does not apply to cases of gross negligence, wilful or reckless misconduct, or breach of statutory duties under applicable Ontario law, including the Occupiers’ Liability Act (Ontario) and the Consumer Protection Act, 2002 (Ontario).

“Ordinary negligence” refers to unintentional acts or omissions in the ordinary course of operations, excluding gross negligence or intentional misconduct.

10. Indemnity (Limited)

Participants agree to indemnify and hold harmless Pilates Hub Newmarket, its owners, employees, contractors, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising directly from their violation of studio rules, misuse of equipment, or negligent acts, except where caused by the studio’s gross negligence, wilful misconduct, or breach of statutory duty.

11. Emergency Care

In the event of an injury or medical emergency, participants authorize Pilates Hub Newmarket to provide or obtain reasonable first aid and to contact Emergency Medical Services (EMS) if necessary. Participants consent to the disclosure of relevant personal information (e.g., name, contact, known medical conditions) to emergency responders if required. Participants authorize us to contact their listed emergency contact when reasonably necessary.

Pilates Hub Newmarket staff are not trained medical professionals, and any assistance provided is voluntary and limited to basic first aid.

Participants are responsible for any related medical costs.

12. Geo-Check-In & Electronic Communications

When using the Pilates Hub Newmarket mobile app, location data may be processed only at the moment of check-in near the studio for attendance verification.

No continuous location history is stored.

Participants agree to receive transactional communications and, where consented, promotional messages in accordance with Canada’s Anti-Spam Legislation (CASL) and the Privacy Policy.

13. Governing Law

This waiver and any related dispute shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal proceedings shall be brought in the courts of Ontario, with venue in the judicial district of Newmarket, Province of Ontario. Dispute resolution is as set out in the Terms of Service.

14. Force Majeure

Pilates Hub Newmarket shall not be liable for any delay or failure to provide services due to circumstances beyond its reasonable control, including but not limited to public health orders, government restrictions, fire, flood, utility failures, staff illness, technological disruptions, internet outages or other emergencies. Any remedies or credits will be provided in accordance with the Terms of Service.

15. Non-Transferability and Personal Participation

Participation rights, memberships, class credits, and any benefits arising under this waiver are personal to each participant and may not be sold, assigned, shared, or transferred to any other person.

Each participant must maintain their own account, sign their own waiver, and attend classes under their own name.

Any individual attending or using studio facilities under another person’s account or membership does so entirely at their own risk and without the protection of this waiver.

Pilates Hub Newmarket reserves the right to deny entry or terminate participation if unauthorized transfer, sharing, or use is suspected.

16. Entire Agreement

This waiver operates in conjunction with the Terms of Service and Privacy Policy available on the Pilates Hub Newmarket website.

If any provision of this waiver is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

By booking or attending classes, participants acknowledge that they have read and understood this document and agree to be legally bound by its terms.

This waiver supersedes all prior verbal or written representations concerning these risks.

17. Electronic Acceptance

By creating an account, booking a class, or attending a session, participants agree that this waiver is accepted electronically in accordance with the Electronic Commerce Act, 2000 (Ontario) and has the same legal effect as a signed paper document.

Continued participation in Pilates Hub Newmarket services constitutes ongoing acknowledgment and acceptance of these terms.

18. Non-Transferability

Waivers, memberships, and class credits are personal to the signatory and may not be shared or transferred without our written consent.

Participation rights, memberships, class credits, and any benefits under this waiver are personal to each participant and may not be sold, assigned, or transferred to any other individual.

Any person attending or using the facilities under another participant’s account or name does so entirely at their own risk and without the protection of this waiver.

Pilates Hub Newmarket reserves the right to deny entry or terminate participation if such unauthorized transfer or use occurs.

If you experience pain, dizziness, or discomfort during participation, stop immediately and notify the instructor.

Your safety is our highest priority.
